Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada.

 

1. Acceptance of Terms

By accessing or using this website, you confirm that you are of legal age in your province or territory and agree to comply with these Terms. If you do not agree, please refrain from using the site or making purchases.

 

2. Products, Orders & Availability

Blue Design Ltd. offers decorative concrete furnishings, mouldings, and architectural finishes. We reserve the right to modify or discontinue any product without notice. All descriptions, images, and pricing are presented in good faith; however, minor variations in colour, texture, or finish may occur due to the handmade nature of our products.

Orders are subject to acceptance and availability. We reserve the right to cancel or refuse any order at our discretion, including those that appear to be fraudulent or violate these Terms.

 

3. Pricing, Taxes & Payments

All prices are listed in Canadian Dollars (CAD) and are subject to change without notice. Applicable sales taxes (GST/HST or provincial taxes) will be added at checkout according to your location.

We accept major credit cards and other payment methods displayed at checkout. Payment information is processed securely by our PCI-compliant provider. We do not store full credit card numbers.

 

4. Shipping, Delivery & Risk of Loss

We ship across Canada using reputable carriers. Delivery times are estimates only and may vary due to weather or logistics. Risk of loss and title for products pass to you upon delivery to the carrier. Please inspect your shipment upon arrival and notify us of any damage within 48 hours.

 

5. Returns, Refunds & Cancellations

Each product is custom made or finished to order. For that reason, returns or cancellations are accepted only in cases of manufacturing defect or shipping damage. Requests must be made within 7 days of delivery with photographic evidence. Refunds or replacements are processed after inspection and approval.

Non-custom stock items (if offered) may be returned within 14 days in original condition and packaging, subject to a restocking fee.

 

6. Warranty

Blue Design Ltd. warrants its products to be free from structural defects in materials and workmanship for one (1) year from the date of purchase under normal residential use. This warranty does not cover normal wear, minor colour variation, accidental damage, misuse, improper installation, or exposure to extreme conditions.

 

7. Intellectual Property

All content on this website—including text, images, logos, designs, and graphics—is the intellectual property of Blue Design Ltd. or its licensors and is protected by Canadian and international copyright and trademark laws. You may not reproduce, distribute, or use any content without written permission.

 

8. Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use or security breach. We reserve the right to suspend or terminate accounts that violate these Terms.

 

9. Prohibited Activities

  • Using the website for unlawful, fraudulent, or abusive purposes.
  • Attempting to interfere with or compromise site security or servers.
  • Copying, reverse-engineering, or reselling website content or code.
  • Posting harmful, defamatory, or infringing content.
 

10. Limitation of Liability

To the fullest extent permitted by law, Blue Design Ltd., its owners, directors, employees, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website or products, including but not limited to loss of data, revenue, or goodwill.

Our total liability for any claim shall not exceed the purchase price of the product giving rise to the claim.

 

11. Indemnification

You agree to indemnify and hold harmless Blue Design Ltd., its officers, employees, and affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your violation of these Terms or misuse of the Services.

 

12. Changes to Terms

We may revise or update these Terms periodically to reflect changes in our operations or legal obligations. Any updates will take effect upon posting to this page, with the “Effective date” revised accordingly. Continued use of the site after changes constitutes acceptance of the updated Terms.

Shipping Policy

Effective date: 20 October 2025

 

Where We Ship

Blue Design Ltd. ships across Canada using reputable carriers and freight partners. Shipping to remote or hard-to-reach locations may require additional time and surcharges. We do not ship to P.O. Boxes for oversized or freight items.

 

Processing & Lead Times

Most items are custom made or finished to order. Lead times vary by product and will be confirmed at checkout or on your quotation. We will provide an estimated delivery window; however, timelines may be affected by weather, carrier capacity, or logistics constraints.

 

Delivery Methods

  • Parcel: Small/medium items delivered to your door.
  • Freight (LTL): Curbside delivery on pallet(s). Driver is not required to move items indoors or upstairs.
  • Appointment Delivery: Where available, the carrier will call ahead to schedule.
  • Liftgate: Recommended for heavy pallets; request at time of order if needed.
 

Risk of Loss & Inspection

Risk of loss and title transfer to you upon delivery to the carrier. Please inspect shipments upon arrival and note any visible damage on the carrier’s receipt before signing. Report shipping damage to us within 48 hours with photos; keep all packaging until your claim is resolved.

 

Split Shipments

Orders may ship in multiple boxes or pallets. Tracking details will be provided for each shipment. Some items may arrive earlier than others depending on carrier routing.

 

International & Duties

Our standard service is domestic (Canada). If international shipping is arranged, you are responsible for duties, taxes, and customs clearance in your jurisdiction.

Refund & Returns Policy

Effective date: 20 October 2025

 

Custom-Made Items

Most Blue Design products are custom made or finished to order. As such, custom items are not eligible for return or cancellation once production has started, except in the case of manufacturing defects or shipping damage reported within the timelines below.

 

Stock Items (If Offered)

Non-custom stock items may be returned within 14 days of delivery in original, unused condition and packaging. Return shipping costs and a restocking fee may apply. Prior authorization (RMA) is required before returning any item.

 

Reporting Damage or Defects

Please inspect your order upon delivery. For shipping damage, note issues with the carrier at delivery and notify us within 48 hours with photos. For manufacturing defects, contact us within 7 days of delivery with a description and images so we can assess and propose a remedy (repair, replacement, or partial refund).

 

Return Authorization (RMA)

To request a return, email info@bluedesign.ca with your order number, photos, and reason for return. We will review eligibility and provide RMA instructions and the return address if approved. Unauthorized returns may be refused.

 

Refunds

Approved refunds are issued to the original payment method after we receive and inspect the returned item(s). Please allow standard processing time. Shipping fees are non-refundable unless otherwise required by law or where the return is due to our error.

 

Non-Returnable Items

  • Custom-made or customized items.
  • Items installed, used, or damaged after delivery.
  • Clearance or final-sale items (where indicated).
  • Items without original packaging or missing components.
 

Exchanges

Exchanges may be offered for eligible stock items if inventory allows. For custom items, exchanges are not available once production has started, unless a defect is confirmed.

 

Warranty Relation

Our separate Warranty (within the Terms & Conditions) covers structural defects under normal residential use for one (1) year from purchase. Refund & Returns does not limit your rights under applicable Canadian consumer protection laws.
